Planned Parenthood Federation of America (PPFA) is a 501(c)(3) charitable organization that supports the independently incorporated Planned Parenthood affiliates operating health centers across the U.S. Planned Parenthood Action Fund is an independent, nonpartisan, not-for-profit membership organization formed as the advocacy and political arm of Planned Parenthood Federation of America. The Action Fund engages in educational, advocacy, and electoral activity, including grassroots organizing, legislative advocacy, and voter education.
As a member of the Office of the General Counsel, the Associate General Counsel will specialize in privacy and data security and will provide senior leadership and business partners with first-rate, effective, and reliable legal counsel. The Associate General Counsel reports to the General Counsel.Purpose: The Associate General Counsel will be principally charged with supporting the PPFA and Action Fund (collectively, National Office) information technology, information security and data-driven initiatives and leading organizational privacy compliance and will provide strategic legal counsel, subject matter expertise and thought partnership in data security and privacy.
EngagementProvide counsel and advice to National Office stakeholders and senior leaders to ensure security, privacy and other risk-related issues are considered for existing and new initiatives in data processing and technologyBuild and maintain strong and trusted relationships with internal and external stakeholdersCollaborate with key members of OGC, National Office management, and other stakeholders such as the Chief Information Officer to ensure the National Office has and maintains appropriate practices and procedures regarding the privacy and confidentiality of protected information
Delivery: The Associate General Counsel’s duties and responsibilities include:Advise and provide subject matter expertise on all aspects of U.S. privacy and information-management laws and regulations applicable to non-profit institutions.Collaborate with key stakeholders to develop, iterate, and effectively implement the National Office’s data privacy strategy, policies and controls to minimize risk, ensure the confidentiality of protected information (e.g., health care, supporter, and donor information), and comply with relevant state and federal laws (including HIPAA)Assess and advise on the structure of programs, projects and policy initiatives relating to information technology, information security, and cybersecurity to ensure legal and regulatory compliance and to mitigate riskLead negotiations in disputes and/or regulatory matters concerning privacy or information managementManage privacy and information management legal matters handled by outside counselCoordinate data security and information privacy trainingsRespond to privacy-related breach or non-compliance, manage investigations and ensure that appropriate corrective action is takenMonitoring Business Associate compliance programs, and ensuring appropriate agreements are in placeActively participating in data privacy and data governance committees or work groupsMonitor and assess federal and state data security, privacy, and consumer protection laws and regulations, understand and monitor the evolution of related best practices, and assess how legal requirements affect and best practices could assist Planned Parenthood initiativesDraft and negotiate complex agreements, including those concerning information technology, information security, and data useProvide oversight of related contractual provisions such as data and financial processing agreements, contracts and clausesAdvise on corporate and/or general non-for-profit corporate and governance mattersConsider and assess internal structures and transactions with related organizations, third party organizations, and vendors
