General Description/Position Overview:

Firstview is a leading provider of payment technology solutions and a prepaid debit card program manager and processor. Our mission is to make digital payments simple, seamless and near-real-time. The Director, Regulatory Compliance is a critical leadership role responsible for overseeing company compliance with all federal and state regulatory requirements including developing and providing secure, reliable, scalable and customer friendly prevention, detection and investigation and claims services that protect customers and Firstview from fraud losses. Additionally, this role serves as the subject matter expert regarding the compliant operations of all payment programs and other services provided by Firstview as well as company-wide compliance with internal policies and controls.

Essential Responsibilities/Duties/Functions:

  • To build out, implement and manage the regulatory and policy compliance management framework amp; program of Firstview; primarily focused on Federal and State financial and prepaid card rule compliance, broader financial crime, data privacy and emerging healthcare compliance (to the extent required by our healthcare customers).
  • Serve as primary point of contact with issuing bank compliance group to 1) respond to regulator questions and examinations; assist in the management of bank issues or concerns; and be the principal point of contact for any third-party audits or examinations.
  • Develop and recommend to the Chief Compliance Officer effective written policies, standards, and procedures to ensure compliance with applicable laws, rules, and regulations regarding the design and operations of payment products and services provided by Firstview to customers and cardholders.
  • Oversee the implementation and on-going execution of processes, procedures and systems that ensure the efficient identification, monitoring and timely reporting of transaction activity considered to be suspicious (SARs).
  • Stay current and advise the Chief Compliance Officer on industry best practices regarding money laundering and terrorist financing behaviors, regulatory issues, compliance policies, and all relevant industry standards that affect the operation of Firstview programs and services.
  • Manage a staff and third-party service providers responsible for the daily execution of all company procedures relating to banking regulations, privacy, anti-money laundering, fraud and chargeback management in accordance with relevant state or federal regulatory requirements.
  • Review and ensure that all program designs and all program materials are developed and maintained in compliance with all issuing bank requirements and that all program materials are regularly reviewed and modified as appropriate to adhere to current bank or regulatory requirements.
  • Supervise both external and internal regulatory audits, as necessary. Interact directly with external auditors, bank personnel and state or federal agencies regarding all inquiries, reviews, or investigations. Prepare responses for remedial action plans as needed for management review and approval.
  • Conduct periodic internal compliance risk assessments, oversee periodic review of compliance with internal policies and standard operating procedures, oversee and manage periodic critical vendor assessments. Ensure that compliance violations or unmitigated risks are reported to the Chief Compliance Officer for review and remediation.
  • Coordinate with Human Resources and others as appropriate to develop and conduct effective compliance training programs for Firstview staff and employees.
  • Provide day-to-day guidance to employees on regulatory matters.


Requirements

Required Education and Experience:
  • Bachelor's degree from 4-year college or university or equivalent work experience. JD or LLM desirable but not required.
  • Financial services industry compliance management required, payment issuing experience is highly desirable.
  • Proven knowledge of laws, regulations, industry guidelines and other requirements relevant to a payment issuing and processing services company including those related to AML, BSA, SOC1, PCI, fraud and privacy. CAMS is required.
  • Exposure to or knowledge of laws and regulations relating to the pharmaceutical and healthcare industry such as HIPAA, anti-kickback laws, and OIG is highly desirable but not required.
  • Competency using MS Office and other productivity tools.
  • Superior written and verbal communication skills and the ability to clearly explain intricate processes and complicated issues to others.
