Job Description

Summary/Objective

The Senior Director, Legal will have responsibilities across the legal function and provide a variety of corporate, commercial and contractual advice and legal services to internal clients, with a primary focus on enabling the go-to-market activities of the company. This role will bring relevant healthcare and/or physician practice experience to the role in order and provide legal advice regarding health care regulatory and compliance matters. The leader in this role will report to the General Counsel and will work closely with her/his peers on a small and nimble legal amp; compliance team, as well as with senior management, outside counsel and employees at all levels. This role will focus on protecting the company from legal and business risks while enabling the company’s continued growth and expansion. This position will ideally be based in Reston, VA, but remote candidates will be considered.

Essential Functions

  • Structure, draft, negotiate and review contracts with a primary focus on physician contracts, but also to include contracts for services, real property, supplies, equipment, information services and software.
  • Assist with the development of corporate policies, systems and procedures, in particular, with systems to facilitate contract initiation, renewal and revision to support ongoing needs of company
  • Provide legal counsel to departments as needed, including on various data and protected health information, security, and privacy-related matters
  • Review and analyze arrangements between hospitals and other parties on compliance for Stark, Anti-Kickback Statute, and other fraud and abuse laws, EMTALA, HIPAA, antitrust laws, corporate practice of medicine, telemedicine and any other regulatory requirements applicable to such arrangements
  • Advise on the development of new areas of sub-specialty as needs may arise

Requirements

Minimum Required

  • Juris Doctor degree
  • Licensed in the state of practice (VA)
  • 7+ years prior experience working in-house or at a law firm, including relevant experience as an attorney in the healthcare industry, including exposure to physician and other provider transactions and federal and state fraud and abuse laws
  • 5+ years of experience in drafting and negotiating commercial and technology-related agreement

  • Business acumen, with the demonstrated ability to balance business needs and legal risks
  • Excellent written and verbal communication skills and strong negotiation skills
  • High attention to detail and ability to successfully navigate in a dynamic, fast paced environment while operating under tight deadlines
  • Comfortable and skilled at managing across multiple senior executive lead stakeholder groups to achieve results with a sense of urgency
  • Ability to build strong working relationships with internal team members throughout the company
  • Collaborative and team-oriented, and able to work independently with little supervision

Preferred

  • Familiarity with health care laws and regulations, including Stark and Anti-Kickback Statutes, state and federal healthcare regulations, HIPAA and other privacy laws, billing and coding compliance and related regulations, Medicare and Medicaid issues and government investigations
  • Experience supporting enterprise sales, marketing, and customer experience teams, including managing a high volume of customer contracts, supporting RFP submissions, and responding to customer regulatory, compliance and privacy requirements
  • Experience providing legal support to a physician group operating in a multi-state telemedicine practice

Additional Eligibility Requirements

• Requires the physical abilities to lift, position, push, pull, and/or transfer materials in excess of 20 pounds. Also requires dexterity in the fingers, hands, and arms to type, write, and manipulate small technical devices.

• Requires the mental and visual ability to view and concentrate on a computer screen and small technical devices.
